II. That plaintiff and defendant were at the commencement of this action and still are actual inhabitants of this state.
III. That in the month of July 1880 the defendant committed adultery with one Wilhelm Van Buren.
IV. That at divers places and at various times between the month of July 1880 and this action, but at what particular times and places, the plaintiff is unable to state, the defendant has committed adultery with various other men, the names of which are at present unknown to this plaintiff.

That five years have not elapsed since the plaintiff discovered the fact of such adultery.
That the plaintiff has not voluntarily cohabited with the defendant since the discovery by him of such adultery.
That there is no action pending, nor has any decree been entered against the said plaintiff, in an action, for divorce, on the ground of adultery, in this or any other State.
That the defendant has failed to prove the allegations contained in the “Fourth” paragraph of the amended answer, that the plaintiff, in the month of September, 1878, committed adultery with a woman who name is unknown to the defendant, in the City of New York.
That the defendant has failed to prove the allegation contained in the “Fifth” paragraph of the amended answer, that the plaintiff, about six weeks after the last mentioned date, committed adultery with another woman, whose name is unknown to the defendant, in the City of New York.

AFTER HIS CHILDREN
Mrs. Van Buren Refuses to Obey the Mandate of the Court.

On the 27th inst. [27 March 1885], Adolph Van Buren, of No. 177 Twenty-second street, obtained a decree of absolute divorce from his wife, Catherine, who lives on Third avenue. Accompanying the decree was an order giving the plaintiff the custody of his three children, aged 8, 6 and 4 years. Mrs. Van Buren was duly notified of the order as to the disposal of the children, but flatly declined to obey it. She left her husband three years ago [in about 1882], since which time she has retained her children. Mr. Van Buren this morning [31 March 1885] filed his application to the [Brooklyn] Supreme Court for a writ of habeas corpus to recover the custody of his children, setting forth that his divorced wife is a woman whose character unfits her to have the care of young children.

CROSS DIVORCE SUITS
Mr. Van Buren Has Procured a Decree and Mrs. Van Buren Another.


Motion was made before Chief Judge Reynolds, in the Special Term, [Brooklyn] City Court, this morning [15 May 1885], to punish Adolph Van Buren for contempt of court. He had suddenly stopped paying the alimony ordered by the [Brooklyn] Court in a suit for limited divorce brought by his wife Katerina. He was ordered to pay $8 weekly, and had paid $50 when he procured a decree of absolute divorce in New York City on the ground that his wife had been living with his brother [apparently Wilhelm, aka William]. No answer was made to that suit. [Note: Not correct, it was litigated to a conclusion.] He discontinued paying the alimony ordered by the Brooklyn court when he obtained the decree in the New York court. Now, Mr. H.A. Meyenborg claimed, $62 is owing to his client, and he moved for the committal for contempt of court for the non-payment of that amount. Judge Reynolds adjourned the hearing to allow the defendant to produce his receipts.

THE VAN BUREN CASE
A New York Divorce Which Stops the Alimony.

Mrs. Katherine Van Buren, a miserable looking woman, has haunted the Court House for many months, as persistently as Miss Flite in the celebrated case of Jarndyce vs. Jarndyce.

[Note:Jarndyce vs. Jarndyce is a fictional court case in Chancery in the novel Bleak House by Charles Dickens. The case concerns the fate of a large inheritance. It has dragged on for many generations prior to the action of the novel, so that, by the time it is resolved late in the narrative, legal costs have devoured the entire estate. The case is thus a byword for an interminable legal proceeding. Dickens used it to attack the chancery court system as being near totally worthless, as any "honourable man among its [Chancery's] practitioners" says, "Suffer any wrong that can be done you rather than come here!" All of the main characters are connected in some way through the case, though the actual legal proceedings appear only as background plot. Aside from the lawyers who prosecute and defend the case, every character who directly associates with it suffers some tragic fate. Miss Flite has long since lost her mind when the narrative begins, and Richard Carstone dies trying to win the inheritance for himself. ]

She flits from one room to another, always gravitating toward the Special Term, [Brooklyn] City Court, where she has long had a motion pending against her husband [Adolph Van Buren] for non-payment of alimony. The case was up on Special Term last week and was adjourned until this morning [22 May 1885]. Chief Judge Reynolds denied the motion to commit Adolph Van Buren for contempt on the ground that he had paid alimony up to the time he obtained his decree of divorce in New York.
Mrs. Van Buren will now have no inducement to haunt the Court House, as the recognition of her husband’s New York divorce will act as a stay to her action for limited divorce. Their children are in a public institution.8



Adolf Von Buren married Marie Margaret Ruof, daughter of Ulrich Ruof and Margaretha Staehli, on 16 May 1886 in Manhattan, New York County, New York.3,9,10,11

Adolf Von Buren died of chronic gastritis; stricture of the pylorus; starvation exhaustive on 31 December 1895 in 212 44th Street, Brooklyn, Kings County, New York, at age 49.1,12,13

Adolf Von Buren was buried on 3 January 1896 in The Green-Wood Cemetery, Brooklyn, Kings County, New York+, in Section 204, Lot 29312, Grave No. 2. On this cemetery lot are buried Gustave A. Van Buren (1895), his grandson Harold John Rudolph Eise (1900), his grandson Francis Jerome Landgraff (1914), his daughter Laura [Van Buren] Landgraff (1919), his second wife Katherine Von Buren (1931), his son Gustave A. (aka Adolph or Otto) Van Buren (1955), and his son's wife Wilhelmina Schindler Van Buren (1969).

There is only one gravestone on this lot which reads:

1878 Wilhelmina [No date]. [December 2, 1998, letter from The Green-Wood Cemetery and The Green-Wood Cemetery Burial Transcript] The Green-Wood Cemetery is located at 500 25th Street, Brooklyn, New York 11232, telephone: 718-788-7850; fax: 718-788-7782.

The Green-Wood Cemetery Burial Transcript states that Gustav A. Von Buren [sic] was born in Germany [sic, actually Switzerland] and died on 31 December 1895 at age 48 years, 7 months and 15 days, which would make his birth date 16 May 1847 (evidently consistent with his death certificate). It states that he died of gastritis at his home at 212 44th Street, Brooklyn. According to The Green-Wood Cemetery Burial Transcript, he is "on records as Adolph Von Buren."

By a December 2, 1998, letter, The Green-Wood Cemetery wrote that Lot 29312, Section 204 was purchased on 2 January 1896 [two days after Gustav's death on 31 December 1895], by Mrs. Marie M. Von Buren, later Hollander [who was Marie M. Ruof who had become his third wife in 1886]. On November 24, 1914, she conveyed the lot to Louise [Van Buren] Eise, Hedwig [Van Buren] Kuckenbecker, Laura [Van Buren] Landgraff and Adolph Von Buren, children of former husband Gustav A. Von Buren. Upon the decease of said Laura [Van Buren] Landgraff, title passed to her son and sole heir, Charles J. Landgraff. Upon the decease of said Adolph Von Buren, title passed to his widow, Wilhelmina [Schindler] Van Buren.

In a 7 March 1999 letter, Diane Khoury speculates that Gustav Adolph Van Buren and his second wife Katherine Stillger Van Buren may have separated. [In fact, they divorced in 1885.] Diane Khoury reports that Katherine (who did not speak much English) told Diane's father that her (Katherine's) husband Gustav had gone off with "die schwarze Marie" (loosely translated as "the despicable, hateful, black-hearted Marie"), who was Marie M. Ruof. So, Gustav Adolph Van Buren divorced his second wife Katherine and married his third wife Marie. But why is his second wife Katherine Stiller VB (who did not die until 1931) buried with him?14,1,15
Adolf Von Buren was also known as Adolph Van Buren. He was baptized on 17 May 1846 in Switzerland. ].4,5 His baptism name was Adolf Von Buren.4

Adolf Von Buren and Emilian Von Buren II emigrated on 20 November 1871 from Switzerland to the United States Family tradition: When the Von Buren sons' mother Kathrina Scherrer died in Switzerland, their father[Philip von Buren] married again to her older sister Elisabeth who was a widow. The second wife did not want the boys around, so they were placed in a "home" or school for boys. There were four sons. Two of them, Emil and Theo decided to come to the USA and did so in 1871 as very young boys. There is a picture taken of them, either in Switzerland before they left, or just as they arrived in the USA. According to Germans to America - Lists of Passengers Arriving at U.S. Ports, Volume 26, October 1871 - April 1872 (page 140), Adolf von Boren [sic], age 25, and Emil von Boren [sic], age 20, both listed as "mechanics", sailed on the ship Palmyra from Liverpool and arrived in Boston on 20 November 1871 (LDS Film No. 419,976). Both are listed as being from an "unknown" village in Germany.

That entry is confirmed by the Palmyra's Passenger List obtained from the National Archives, which also adds that the brothers traveled across the Atlantic Ocean in steerage.

When the "von Buren" brothers arrived in America in 1871, they apparently sometimes changed their last names to "Van Buren" (perhaps because Martin Van Buren had left the U.S. Presidency only 30 years earlier in 1841, and therefore the name Van Buren may have sounded more "American"). Emilian also changed his first name to "Adam Emile". He also named his first born son Phillip (after his father) Martin (after the President?) Van Buren.16,17,18
Adolf Von Buren was also known as Gustave Adolph Van Buren, Sr. Adolf also evidently changed his first name to "Gustav Adolph". Aldolf was also apparently known as "Otto" in America, which was evidently the name of his first born son in Switzerland.

It is strange that Adolf von Buren left Switzerland in late 1871, because he was apparently married and had at least three children, including a daughter Rosa von Buren who had been born to his wife on 12 August 1870 and another daughter Maria "Louisa" who may have been born in April 1872 after he had arrived in America.


Adolf Von Buren was a stone cutter and worker in marble in Brooklyn, New York, and carved many gravestones.
Adolf Von Buren was also known as Otto Van Buren.

Adolf Von Buren and Katherine (Kate) von Buren appeared on the census of 1880 in Brooklyn, Kings County, New York, which lists "Otto" Van Buren, 34, born in Switzerland, as were both of his parents; his wife Catherine [sic; actually Kathrine], 36 (although she may have been only 32), born in Germany, as were both of her parents; and their daughters Hattie [actually, Hedwig], 3, born in New York, and Catherine [actually, Laura], 1, and also born in New York. This is the only census in which "Otto" is listed.

He was a marble cutter in 1880.20 He lived in 1881 in 227 22d, Brooklyn, Kings County, New York.21 He and Katherine (Kate) von Buren lived on 2 June 1881 in 712 5th Ave (8th Ward), Brooklyn, Kings County, New York.22 He was a stone letterer on 2 June 1881.22

Adolf Von Buren was naturalized on 28 October 1881 in Kings County, New York.23 He lived in 1883 in 229 22nd St., Brooklyn, Kings County, New York, He appears in various Brooklyn, New York, city directories as "Gustav", "G.A." and "Adolph". For example, in The Brooklyn City Directory for 1883-84, he is listed (at page 1256) as Gustav Van Buren, cutter, living at 229 22nd Street. A Brooklyn City Directory shows that in 1890, G.A. Van Buren lived at 177 27th Street, Brooklyn, New York. The 1891-92 Brooklyn City Directory gives his address as 212 1/2 44th Street, which was still his address at the time of his death in 1895. The 1901-02 Brooklyn City Directory indicates that "Marie M. Van Buren, widow of Chris'r [sic?] A." [apparently Gustav's third wife and widow Marie Margaret Rouf] lived at 212A 44th Street. On the the LDS website, I stumbled into the marriage of "Gustuv" Adolph von Buren to Marie Ruof in Manhattan, 16 May 1886!! She must be the "schwarze Maria" my father remembered his grandmother (Katherine Stillger VB, G. Adolph's second wife) talking about, and the same Marie Van Buren who purchased the VB burial lots in Brooklyn's Greenwood cemetery when Adolph died. The marriage date makes some other matters clearer. My father said his mother, Hedwig VB, and her siblings Laura and Adolph Jr. spent some unhappy time in an orphanage as children while their mother was unable to keep them together. At the time of G. Adolph's third marriage [to Marie Ruof in 1886], these children ranged in age from 5 to 9, not able to care for themselves without supervision. So far, I have been unable to locate any other relatives in the U.S. who might have been able to help Katherine Stillger VB with her children after Adolph left her.
As for Marie Ruof, wife #3, she was born in canton Bern, Switzerland, but I found that her parents and their children emigrated to the Monticello, Iowa, area about 1882. How she ever got to marry Adolph VB in New York City in 1886 is a mystery, but perhaps Adolph knew the family back in Switzerland. As I told you, I originally thought that Gustav Adolph had come from Bern. That was the only area ever mentioned in connection with him. Perhaps he worked there at some time before coming to the U.S. Without the complete original marriage record, I don't know Marie's age, but it appears she may have been quite a bit younger than Adolph. Obituaries of Marie's Iowa brother and sister are posted on the web, giving their births in the 1860's, and census indexes list the same decade for two other brothers.
So--after the holidays you can add Marie's name to the Van Buren genealogy.
Later this winter I'll be sending you another name and marriage as well. Our son Paul is planning to marry in February, so we're looking forward to that. Dwight will be best man at the wedding!

Adolf Von Buren and Marie Margaret von Buren appeared on the census of 16 February 1892 in Brooklyn, Kings County, New York, which lists Gustave Van Buren, 46, born in Switzerland, his wife Marie Van Buren, 30, also born in Switzerland, and his children [by his former wife Katherine Stillger] Hattie, 15, Laura, 12 and Gustave [Jr.], 11, all born in the U.S.25 He was a letter cutter (for gravestones) in 1892.26

Adolf Von Buren left a will dated 6 December 1895 in Brooklyn, Kings County, New York.27,28

His estate was probated in 1896 in Surrogate's Court, Kings County, New York, The Gustave A. Von Buren estate was valued at real property worth $1,400 and personal property not more than $300. He was survived by his widow, Maria M. Von Buren, an adult daughter Mary Louise Von Buren, and three minor children Hedwig (19 on 26 January 1896), Laura (17 on 5 April 1896), and Gustave (15 on 2 June 1896). Maria was the stepmother of the four children.

According to Diane Khoury, Marie M. Von Buren had a tough time keeping the family together because of her husband's illness and death in 1895, so for a time she had to place her three stepchildren (Hedwig, Laura and Gustave Adolph) in a Catholic orphanage. The 1900 census for Mount Vernon, Westchester County, New York, shows that Gustave "Adolph" Van Buren, age 19, was living with the family of his uncle, William Van Buren, Sr.
