Elisha (the Elder) AVERY’s land ownership problems.
Stephanus Van Cortlandt owned thousands of acres of land in the NY and CT area when he died in 1700. A portion of these lands was the Pound Ridge area. Title was not firmly stablished and the area was settled upon by squatters. By 1750, several people, including Elisha Avery and Ebenezar Green had purchased land in this disputed area. In 1753 the Van Cortlandt heirs began legal proceedings to establish title to the Pound Ridge lands. In 1760 a suit for ejectment was filed against Elisha Avery who claimed 400 acres (”one dweling house, one barn, one garden, one orchard, 100 acres of land, 100 acres of meadow, 100 acres of pasture, and 100 acres of wood”). In order to establish a jury for the case, the court ordered that a list of freeholders be prepared in 1763.

Elisha did not have the resources to wage an extended legal battle and, in 1766, the case was resolved out of court in favor of the Van Cortlandts. As part of the settlement, Elisha AVERY and others were given the right to lease and eventually purchase the land. A map
