Wayne County, NC - Will of Elijah Hinson, 1801

This day of the 9th month comonly called September in the year of our
Lord 1801 - I Elijah Hinson of Wayne County being sick and very weak of
boddy but of sound mind and memory and calling to mind the mortality
of my body and knowing that it is appointed for all men once to die do
make and ordain this instrument to contain my last will and testament
that is to say principally and first of all I commend my soul into
the hands of my Creator that gave it and my boddy to the earth to be
buried in a Christian like and decent manner at the discresion of my
executors and for what wourldly estate it hath been my creators will to
bless me with in this life I give devise and dispose of in manner and
form following to wit
Item I lend to my beloved wife Susanna Hinson all the lands and plantations
whereon I now live with all my stock and horses cattle hogs and sheep and
all and singular the house hold and plantation utentials and all the usefull
articles of every kind nothing excepted to be at her own liberty to do and
us as she thinks most advantage to the rasing and maintaining the (fold in
paper) children during her life or widowhood for them not to be parted or
put away from her during her life and it is my will and desire that the
children __ to their mother and help and assist each other whilst __ but if
they will not and proves disobediant I leave it in __ power to sel of the
living such as she can best spair for her support and the small children and
it is my desire that if their mother should die and leave either of the children
under age that the rest all go an equal part for taking care and supporting
them until they come of age and that the living remain uninteruped and if
their __ any one of them that refuses assistance those that take it upon them
to be alloud out of the living for their __ but if all go their equal part
and their mother be dead and the youngest child of age it is my will wish and
desire that what of the living be left be equally divided amongst sons and
daughters all that is living remain uninterupted but with this previson that
the executor see that they take prudent steps so as not to destroy the living
__ they should see and find that it will not do for the living to stand so
and their should be either one that is not able to __ and close that the
executor take as much of the living __ will support them whilst they are
and the rest of the living to be equally divided the executor taking charge
of those in their non age and their part and lastly I desire that my executors
pay all my just debts and gather in all that is due to me and now nominate
and appoint Susana Hinson my beloved wife and Nathan Pike and Jesse Dawson
executors of this my last will and testament revoking disannulling and making
voide all other wills and testaments be me made confirming this and know other
to contain my last will and testament in witness whereof I have hereunto set
my hand and afixed my seal the day and date first within written signed
sealed and delivered

Children and Wives of Elijah(1) HINSON
28 Feb 2008: This whole issue has been resolved - There is no longer any issue of whether Elijah(1) had a first wife Phebe. Resolution = NO. Therefore all of the children of Elijah (1) were by wife Susannah. (See addendum at end of this note)

I speculate that Elijah(1) had at least 1 child (Menoah(1) and possibly a 2nd child Louise(1) by 1st wife Phebe ____ and 8 (or 9)children (Louise(?), Patience, Clarkey, Isaac, Susannah, Elijah(2), Borden, Lavina, and Ailse) by 2nd wife Susannah SCRUVEN.
No record of dissolution of 1st marriage or death of Phebe has been found. Elijah's will does not even name the children and provides no enlightenment as to the existence of a wife before Susannah.
In fact, the only record of Phebe's existence is in Hinshaw, Vol 4, p. 148, where Manoah is given as son of Elijah(1) & Phebe.
Also, the Contentnea MM birth record book
288 lists the children of Elijah(1) and Susannah as Isaac, Clarky, Susanna, Elijah(2), and Borden. Presumably, the record was made before the births of the last 2 children Lavina, and Ailse. This supports the idea that Manoah and Louise, both older than Isaac were born of Elijah(1) and (someone else, perhaps Phebe)
However, if Louise and Manoah were children by a previous marriage, then Susannah certainly "adopted" them (in a practical sense, if not legally). She and Elijah(1), together as parents, requested that Louise be accepted into Contentnea MM. Susannah also brought Louise and Manoah with her to Ohio after Elijah(1)'s death in 1802. Louise (Lovice, Lovisa) is given as daughter of Elijah(1) & Susannah when she marries Jeremiah Cook in 1812 or 1813.
307If Elijah(1) indeed had 2 wives, the birthdates of the children provide some insight of when Elijah(1) married Phebe. If Louise was a child of Elijah(1) & Phebe, then Elijah(1) & Phebe were probably married before 1781, the birth year of Louise. On the other hand, if Louise was a child of Elijah(1) and Susannah, then Manoah(1), born after Louise in 1783 must also have been a child of Elijah(1) & Susannah, putting the whole issue of Elijah(1)'s marriage to Phebe into question.
Likewise, Elijah(1) might have married Susanna after 1783, the birthyear of Manoah(1), but before 25 Nov 1787, the birthdate of Patience.
Finally, Susannah was reinstated into Contentnea MM on 8/12/1786 as Susannah HINSON so she had married Elijah(1) before 8/12/1786.
In summary, the whole issue of a 1st wife of Elijah(1) named Phebe is based on a single record
294 and the best counter-example is also a single record
308 and the relative birth dates of Manoah(1) and Louise

The whole issue of whether Elijah(1) had a previous wife Phebe and whether some of Elijah(1)’s children (Manoah and Louise) were by wife Phebe was introduced by a single record in Hinshaw
310 which said, in effect, that Manoah was the son of Elijah and Phebe. The Friend’s Historical Library at Swarthmore, PA has copies of the original Quaker records from which the Hinshaw record was extracted on microfilm. I inspected the original handwritten marriage record for Manoah to Rachel. The record was unambiguous - Manoah was the son of Elijah and Susannah (not Phebe).

Notes) and Elijah HINSON of Stafford Co., VA ., NC is proven in Stafford Co., VA during 1785-1789, overlapping time frames.
